This privacy policy will automatically take effect for all existing users on 25 May 2018, replacing previous privacy notices. The continued use of the Relux.com platform and software applications of Relux Informatik AG will be subject to the new privacy policy from this date.
The further use of the Relux.com platform and software applications of Relux Informatik AG by users is only possible with the consent of the data protection declaration and the data protection guidelines of Relux AG.
1. General and purpose of data processing
When using the Relux.com platform and software applications of Relux Informatik AG, we collect anonymised and personal data from users of legal entities. We need this data to adequately fulfil the contract between you and us and to comply with our legal obligations. Without this data, we may not be able to provide you with all the services you require.
Users and members are exclusively natural persons related to companies or legal entities that obtain services from Relux. In this respect, personal data on users and members of legal entities and, in exceptional cases, of private persons are kept.
Products of Relux Informatik AG that are subject to a charge are sold and delivered exclusively to legal entities.
However, the free products of the relux.com platform can also be downloaded and used by private individuals. For these private individuals, the data protection regulation and data protection declaration apply.
2. How we use the data we collect
We use, store and process information, including personal data, about you in order to provide the Relux.com platform and Relux Informatik AG software applications, to be able to process registrations for webinars and training courses as well as orders, to analyse, improve and further develop as well as to create and maintain a trustworthy and secure environment and to comply with our legal obligations.
2.1 Provision, improvement and further development
So that you may use the Relux.com platform and software applications of Relux Informatik AG.
To further develop and improve the Relux.com platform and software applications of Relux Informatik AG and to phase out unused functions.
To provide our customer service for administration, support, e-learning and e-shop.
To send you service or support messages such as updates, security alerts and account notifications.
The data and rights of your invited contacts in your account will not be used for any other purpose and are the sole responsibility of the account holder.
2.2 Creating and maintaining a trustworthy and secure environment
To detect and prevent fraud, spam, abuse, security-related incidents and other harmful activities.
To carry out safety investigations and risk assessments.
To comply with our legal obligations.
To settle any disputes with our members and to enforce our agreements with third parties.
To enforce our terms and conditions of sale, delivery and licensing or other policies.
2.3 Provision, personalisation, measurement and improvement of our advertising and
marketing measures
To send you special promotions, marketing information, advertising and other information that may be of interest to you based on your preferences.
To personalise, measure and improve our advertising.
For the implementation of recommendation programmes, loyalty bonuses, surveys, competitions, prize competitions or other sales-promoting measures or events carried out by Relux Informatik AG.
2.4 Payment services
To enable you to access and use the Payment Services.
To detect and prevent fraud, abuse, security incidents and other harmful activities.
To carry out safety investigations and risk assessments.
To carry out checks on databases and other sources of information.
To comply with legal obligations (for example, money laundering regulations).
To enforce the terms and conditions of sale and delivery.
3. Data collected by us
The data we collect is divided into two categories.
3.1 Data that you transmit to us
Account data. When you set up a Relux account, we require mandatory information: Your first and last name, email address (will be verified), country, as well as in which industry you work. For the hotline and forum, a personal photo, title, business and mobile phone numbers, time zone, Twitter account and preferred language in communication with Relux Informatik AG can be stored additionally and optionally.
Communication. To communicate with other account holders who you invite to your account for the purpose of sharing your saved favourites and own products.
Payment information. For the purchase of licences, for webinars or training courses in the training centres of Relux Informatik AG or their official distributors in various countries of Relux Informatik AG. We may ask you to provide your billing and shipping address as well as bank account or credit card information to facilitate sales-related processes. Credit card information is not stored by Relux Informatik AG (for more information see point 7, Payment services).
Crash data. In the event of support, you can send this data to Relux Support support@relux.comzwecks to make it easier to find possible errors. Such a file is deposited manually by the user as an attachment to the communication.
Support. When contacting Relux Informatik AG support, please inform us of the circumstances, the type of enquiry, the product name to which your enquiry relates and, if required, provide an attachment - usually a project file - to which your enquiry relates.
Forum. The forum is a publicly visible platform where account holders can exchange information, create new topics and communicate with each other.
3.2 Data we collect automatically
Location data. To identify the exact or approximate location, the IP address of the end device is determined and stored in the account data, so that the products available for these countries from retailers and manufacturers can be listed.
Usage Data. We collect information about your interactions with the Relux.com platform, such as the pages or other content you view, your search queries and product downloads.
Which manufacturer products are downloaded and used in planning.
Log data and device information anonymised. When using the Relux.com platform and software applications of Relux Informatik AG, we automatically collect anonymised log data and device information, what you use of it (including any clicked links to third-party applications), access data and times, information on hardware and software used, device information, data on device events, unique identifiers, cookie data.
Licence codes. Fee-based services and licences are monitored by the external partner WIBU Systems. Only customer and order numbers of legal entities are stored. Authentication of the person or the personal data of a legal entity is only possible manually by employees of Relux Informatik AG in the internal sales systems via the order number.

4. Disclosure
Relux is entitled to pass on the above-mentioned account data, usage data and anonymised log data of users who work with the Relux.com platform and software applications of Relux Informatik AG as follows.
4.1 Passing on to
Contractual partners. Contractually or corporately bound companies that support Relux in parts of its business processes or offer content, products and services jointly with Relux. These companies only use the data when their services are used by members or users and may not be passed on to third parties. For more information on these and other companies and their role in this, see section 7.
Relux members. Members of Relux. This is a restricted disclosed group of members on relux.com. These members may only use the data for their own purposes and may not pass it on to third parties or use it for non-business purposes without the consent of the customer/member.
Legal obligations. Relux Informatik AG may disclose your data, including personal data, to courts, law enforcement agencies and other state authorities as well as to authorised third parties if and to the extent that this is required or permitted by law or if the disclosure is necessary from a factual point of view. This applies in particular:

In response to requests for data protection information/verified requests in accordance with the existing data protection request form.
To enforce and apply our Licence Terms, Terms of Sale and Delivery, T&Cs for Members, T&Cs for ReluxNet Members and individual agreements.
Business Combinations. If Relux Informatik AG engages in or is involved in a merger, acquisition, reorganisation, asset sale, bankruptcy or insolvency proceeding, we may sell, transfer or share our assets, including your information - in connection with or contemplating such a transaction (e.g., due diligence). In this case, we will notify you before personal data is transferred and thus becomes subject to a different privacy policy.
Aggregated data. Relux Informatik AG may also share aggregated data (information about our users that we combine so that individual users can no longer be identified or referred to) and other anonymised data for regulatory compliance, industry and market analysis, demographic profiling, marketing and advertising, and other business purposes.
4.2 Justification of the transfer
Contractual partners. Companies affiliated with Relux Informatik AG by contract or under company law in order to be able to provide you with services (e.g. online helpdesk, for more information see chapter 7).
Relux members. Relux members finance the Relux.com platform and software applications of Relux Informatik AG with their annual fees to an above-average percentage and would like corresponding anonymised figures on the number of installations of desktop applications and on the use of the platform.
Furthermore, Relux members would like to know who (non-anonymised data: with country, company name, title, first and last name, email address) downloads their product data from relux.com and uses it for their own purposes.
Legal obligations. To fulfil our legal rights and obligations.
Corporate mergers. Entrepreneurial freedom resp. reduction, prevention of damage of possible contractual partners.
Aggregated data. Publication of figures on the number of users, programme installations etc. based on anonymised data. Such data is an important basis for decision-making in business relations with Relux members.
5. Data protection-relevant settings of an account
Owners of a relux.com account have the option of informing Relux Informatik AG whether they wish to receive newsletters or not.
Non-acceptance of data protection provisions will result in restricted functions without this consent, neither product data of Relux members can be downloaded from the relux.com platform nor desktop versions of Relux Informatik AG can be used.
6. Deletion of an account
Owners of a relux.com account have the possibility to delete their account including all contents at any time and independently. If you delete your account, all support requests and forum posts on our support platform (Freshdesk) will also be deleted automatically.
This requires a successfulLogIn with subsequent call and confirmation of the delete function.
Relux Informatik AG logs a successful deletion for security reasons. Subsequent recovery of this data will no longer be possible.
7. External partners and integrations
To fulfil our services, Relux Informatik AG uses services/applications from partner companies, which are listed in this chapter. Relux Informatik AG is neither the owner of these companies nor in a position to control them. When you interact with these partner companies, you can transmit data directly to the external partner, to Relux Informatik AG or both. These partners have their own rules about the collection, use and transfer of data, but must comply with the data protection guidelines according to DSGVO. This applies insofar as Relux Informatik AG obtains or delivers personal data via these tools.
7.1 Support & Forum & e-learning & e-shop
For these functions, Relux Informatik AG uses products from Odoo, Rue du Laid Burniat 5, 1348 Louvain-la-Neuve, Belgium. This is an on-premise solution. This means that all of this user data is located on Relux's own online servers.
7.2 Licence codes
Relux Informatik AG uses products of WIBU Systems AG, Rüppurrer Straße 52-5476137 Karlsruhe, Germany for chargeable services and licences. You can find the data protection regulations of WIBU Systems AG here.
7.3 Social media platforms
Relux Informatik AG uses social media platforms such as Facebook, LinkedIn, YouTube etc. to communicate with users. The personal data of these followers is located exclusively in these social media platforms and is neither actively used nor controlled or monitored by Relux Informatik AG. Therefore, questions regarding the processing of your personal data by the provider of your social media platforms should be addressed to these providers.
Please note, if you no longer wish to receive messages on these social media platforms from Relux Informatik AG, you must unsubscribe as a follower in the corresponding topics or groups.
7.4 GIScience
Certain areas of the relux.com platform use the services of Heidelberg University for map functions. Relux Informatik AG does not store any user-specific data when using this area. The data protection regulations of Heidelberg University can be found here.
7.5 E-mail client
Relux Informatik AG sends its newsletters via the MailChimp product of the company The Rocket Science Group, LLC. You can find out more about the privacy policy of the Rocket Science Group here.
7.6 Survey tool
Relux Informatik AG creates surveys via the product Survey Monkey from the company of the same name Survey Monkey. You can find out more about Survey Monkey's data protection policy here.
7.7 Payment services
Relux Informatik AG does not store any credit card information of customers in the e-shop. This information is held exclusively by SIX, Pfingstweidstrasse 110, 8005 Zurich. You can find the data protection regulations of this company here.
7.8 Google Analytics & Google AdWords
Accesses, duration of stay, downloads etc. of the relux.com platform are monitored with Google Analytics and stored anonymously. There is no connection between an account on relux.com and this data.
Google AdWords campaigns help Relux Informatik AG's services to be found. Corresponding evaluations are anonymised. There is no connection between an account on relux.com and this data.

8. Cookies and related technologies
web servers may collect information about your use of the website. This is done with the help of cookies.
Cookies are pieces of information that are stored by your web browser on your computer's hard drive. When you return to the relevant website, the server automatically recognises the cookie and provides information about your last visit. Most browsers accept cookies automatically. You can prohibit or block the creation of cookies in your browser.
In the area for users of the relux.com platform, cookies are used to ensure that the browser recognises users by storing the login data in a cookie. Calling up the relux.com platform from local applications of Relux Informatik AG also ensures that only readable product data is offered for the respective applications (e.g. rfa product data for users of Revit from Autodesk).
If you do not allow cookies on your computer, you will have to log in to the relux.com platform manually and select the appropriate product data formats yourself. Further restrictions are not excluded.
9. Your rights
You may submit any of the matters described in this section to our Data Protection Department in writing via our "Data Protection Enquiry Form" in the event of any discrepancies. Please note that we will only process fully completed forms and may ask you to confirm your identity before taking further action.
We reserve the right to invoice or refuse requests according to internal as well as external accruing expenses to the applicants according to DSGVO chap. 3, section 1, art. 12, clauses 5 and 6 or according to DSG DSG art. 20 clauses 1-4.
9.1 Duty to inform
With reference to this data protection policy of Relux Informatik AG, the user has all the necessary information (according to DSGVO ch. 3, section 2, art. 13, item 1 or DSG art. 19).
9.2 Right to information
Upon request, we will provide you with clear information on the processing of your personal data in accordance with DPA Ch. 3, Section 2 Art. 15. This information is free of charge subject to DPA Ch. 3, Section 1, Art. 12, No. 5, or in accordance with DPA Art. 25. This information is free of charge subject to DPA Art. 26, Art. 27.

9.3 Right to rectification and deletion
The user has the right to correction and deletion (see also chap. 6 of the Relux Informatik AG data protection policy) of personal data at any time (pursuant to DSGVO chap. 3, section 2, art. 16 & art. 17) or DSG art. 32, no. 4.
9.4 Right to restrict processing
The user has the right to demand the restriction of processing (according to DSGVO chap. 3, section 3, art. 18) from the controller or to make this himself/herself in the account settings. See Chapter 5 of the Data Protection Policy of Relux Informatik AG.
9.5 Right to notification in the event of correction or deletion of personal data
The user has the right to be notified by the data controller in case of correction or deletion of personal data. The deletion of personal data can be carried out by the user himself/herself in the relux.com account. He/she will receive (according to DSGVO Chap. 3, Section 3, Art. 19) a corresponding automated notification as confirmation of the deletion.
9.6 Right to data portability
The user has the right to all personal data on relux.com of Relux Informatik AG (according to DSGVO Chap. 3, Section 3, Art. 20) in a machine-readable format. On relux.com these are "own products" in the own account as well as personal data (country, industry, company name, company address, billing address, title, first name, last name, photo, email address, telephone number, mobile number).
10. Data Breach
Relux Informatik AG regularly commissions external cyber security companies to check the security of the systems.
As a rule, the sales data stored by Relux Informatik AG does not contain any sensitive information from private individuals. Information is therefore not provided.
